A CONVICTED rapist has admitted lying about his identity and tricking his way into a relationship with a woman in Ayrshire.

Alan Badley, 36, pleaded guilty to a pair of charges when he appeared at Kilmarnock Sheriff Court on Tuesday, July 23.

Badley admitted twice breaching court requirements as a registered sex offender by failing to inform police within three days that he was using another name.

The offence was committed between January 9 and October 3 last year.

He also failed to notify police of his registered address betwen July 1 and September 30, 2023.

Badley was made subject to the requirements in 2008, when he was convicted of rape at Liverpool Crown Court and was placed on the sex offenders register for life.

Fiscal depute Jaide Podlesny told the court that a woman had come across Badley on dating site 'Badoo', where he was acting under a username similar to "Damo".

The convicted sex offender, described in court papers as an inmate at HMP Kilmarnock, also informed the woman that his name was "Damian Fletcher".

He told her that he lived in England with his sister, who was named in court.

The pair would continue to interact, later having Facetime conversations, before Badley travelled to the woman's home address in Ayrshire.

He stayed with her for a few days before returning home, meeting members of her family, including her children, during his stay.

Badley travelled to her home again the following week, and by July 2023 had "essentially moved in with her", Ms Podlesny said.

At this stage the 36-year-old admitted to the woman that he had been in prison previously, but he told her he'd served time behind bars for "stealing motor vehicles".

At a later date the woman was told by a cousin of Badley that his first name may be Alan, though the cousin did not provide a surname.

 

On being questioned, Badley admitted his real first name but said he did not like using it as it reminded him of his past.

His real surname was still not disclosed.

Following this interaction, the pair's relationship came to an end.

The woman then found her now ex-partner's sister on Facebook and noted that she used the surname Badley.

She then Googled the name 'Alan Badley' and found a number of news articles reporting his previous conviction for rape.

Police were contacted on October 3 and later traced Badley, who at first gave his name as 'Damian Fletcher' before eventually admitting his true identity.

 

Defence solicitor Hugh Duncan asked Sheriff Colin Bissett to take into account that Badley had pleaded guilty at the earliest opportunity and that his client had been on remand in prison since October 4.

Sheriff Bissett told Badley: “You were made subject to lifetime notification requirements as a sex offender because you were convicted of the most serious type of sexual offence known to this court.

“You have thereafter repeatedly failed to abide by the conditions of that order.

“You have actively set out to deceive someone and found a way into her life and that of her family.

“Due to that background I have to take a very serious view of these offence.”

Sheriff Bissett sentenced Badley to 'time served' meaning the custodial sentence imposed matches his time on remand.

Badley will spend no further time in jail in connection with the offence.
